This document discusses and discloses the privacy policy and practices (this "Privacy Policy") for the internet web site operated by Jorge Ramos Technologies LLC (collectively with its subsidiaries and affiliates, including without limitation Hero Security (NY) LLC, the "Company"). The terms of the Privacy Policy apply to all internet or web sites and mobile applications operated by the Company, including getheroapp.com (collectively, the "Site"). The Company wants you to know and understand the terms and conditions established by us relating to the collection and use of your personally identifiable information through the Site. For these purposes, "personally identifiable information" means data and other information transmitted or communicated via the internet that can be used by the Company to identify and contact a unique individual, including without limitation your location, photograph and any other material and information you might upload or post on the Site. Data we collect The Company collects personally identifiable information when you visit the Site's pages or when you voluntarily provide information to the Company through the Site. The Site automatically logs information about you from your browser when you visit the Site, such as your IP address, the Company web pages you visit and similar information. You may also choose to voluntarily provide us with information about you at various places on the site. Personal information which we may ask you to provide includes your name, location, email address, telephone number and other similar information, as well as credit or debit card information. In particular, in order to connect you with a Hero and ensure the safety of and to monitor the course of your Journey with the Hero, we collect location data as you use the Site. This location data is used by us and shared as provided in the "Location Information" portion of the Site. The Site may place and access cookies when you visit the Site. A cookie is a small data file that web sites commonly write to your hard drive when you visit them. A cookie file contains information that can specifically identify you each time you visit the site. The Company uses cookies as a way to measure activity and traffic patterns on the Site. We also use information gathered from the placement of cookies to customize and enhance your experience on the Site, for example by retaining your name and address and other information that you have entered during your visit to our site for ease of future access and transactions. You may choose to set your computer to reject cookies if you desire, but the methods for doing this differ from browser to browser so you will have to check with your provider to be certain. Note also that disabling cookies may make certain parts or aspects of the Site unavailable or non-functional to you. From time-to-time the Company may request that visitors to the Site provide additional information, generally via surveys or contests. Participation in these surveys or contests is completely voluntary and you will thus have a choice whether or not to disclose additional information that may be requested. Information requested via surveys and contests may include additional demographic information, but will usually be pretty obvious from the information requests and context. Other use we may give to collected data In addition to the use we may make of cookies, the Company may also use the information collected through the Site to send you information and promotional material by email or other non-SMS channels (SMS is used solely for one-time verification codes, not for marketing or promotional messages), to process your requests for information or services and to customize and improve the site for your future visits. Data we may share and how we share it The Company is not in the business of selling or renting your personally identifiable information and will not do so. However, we may share information about you with others only under the following circumstances: - when necessary to third parties who work for the Company in order to process your requests or provide you information; - when you expressly consent to disclosure; - when you use the Site to arrange for a Hero to accompany you on a designated Journey, as may be necessary to complete the transaction and process payment; - by operation of law, when such information is transferred as a part of a sale of assets including the assets represented by the Site; - to comply with law, court orders, subpoenas or other valid legal process; or - to enforce or apply the Company's agreements or protect the Company's rights. In the event that the Company or substantially all of its assets are acquired by a third party, your information may be one of the transferred assets. Links to other sites The Site may contain links to other web sites and you need to be aware that other, non-Company web sites may not follow the same privacy policies as the Company. For instance, if you click an ad on the Site, you may be directed away from the Site to an entirely different web site not owned or maintained by the Company. Examples of this include links from advertisers, content providers and trade partners who may also use our logo or our style as part of a co-branding agreement. It should usually be clear when you have ventured from a Company Site, but be mindful that some of these other web sites may collect data from you that the Company would not and may use that data in ways that the Company would not. Security The Company takes considerable precautions to protect your personally identifiable information against theft, loss, misuse, unauthorized access, disclosure, destruction and alteration when you visit the Site. In certain areas of the Site, your information may be protected using standard Secure Socket Layer (SSL) encryption technology. While we use SSL encryption to protect sensitive information online, we also take steps to protect user-information off-line. We may contract with third parties for payment processing and other functions related to your use of the Hero App and the Services, however we select our business partners with great caution and care and ensure that the partners have privacy and security measures in place that meet our requirements. All of our users' information is restricted to use only for business related purposes. All of our employees and contractors that might have any access to personally identifiable information are kept up-to-date on our security and privacy practices-which are strictly enforced. Any time new policies are added, our employees and contractors are notified of the changes and reminded about the importance we place on privacy, as well as being updated on what they can do to ensure that your personally identifiable information is protected. Correcting and deleting information we collected from you If the information you have given the Company through your use or access of the Site changes and you would like to modify it or if you would like to view the information the Company has about you, you currently have only one option. You can delete your account, and 15 days later we will automatically delete all of your information. When the 15 days have passed, you can create a new account with the changes that you wanted to make. If this period is too long for you under the circumstances, you can contact Support and we may be able to facilitate this process. We expect in the near future to give users the ability to make changes to an existing account without going through the deletion process. SMS / Text Messaging Hero sends one-time verification codes (OTP) by SMS text message for the sole purpose of authenticating your access to your account. These are transactional messages; Hero does not send marketing or promotional text messages. When you provide your mobile number to receive a verification code, we collect your phone number and the consent record associated with that request (including the date, time, and the version of this Privacy Policy and our Terms of Service then in effect). No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information collected as part of the SMS verification process — including your phone number, opt-in, and consent — is used only to deliver and secure the authentication service, and is not sold, rented, or shared with any third parties. Message and data rates may apply depending on your mobile carrier and plan. Message frequency varies and is limited to verification codes you request. For help, reply HELP to any message; to stop receiving verification codes by SMS, reply STOP (note that disabling SMS verification may affect your ability to sign in). We may change this Privacy Policy occasionally The Company may alter, change, amend or substitute this Privacy Policy from time to time. If the Company decides to change this Privacy Policy, we will post the upcoming changes to the Privacy Policy on the Site in advance of the changes taking effect. You should periodically check the Privacy Policy on the Site to review any pending or other changes.
