Hero Engagement Agreement

Between

Hero Security (NY) LLC
(the "Company")

And
	
("you", or the "Hero")
	Congratulations!  You are now closer to becoming a Hero ... We hope to soon welcome to the team!  Because of the new and somewhat complicated operations of the Company, you will be introduced and asked to consent to a number of policies and procedures designed to allow the Company to deliver safe, efficient services to our customers, as well as to protect each Hero and our business.  In this Agreement, we will go over some of the things that we need to get you fully onboard and ready to participate in our unique personal security services.  Many of the things discussed below will be incorporated into the online application process, and some will not.  For things that are included in the online process, this document provides some context around why we are asking some of these questions. 

	First, we need to know a little bit of personal information about you to be able to confirm your fitness for security guard work, to identify you clearly, resolve any claims of falsification of your identity and other issues that may come up when you are a Hero for us.  With that in mind, how tall are you in feet and inches, and how much do you weigh, in pounds?  Further, what's your approximate age?

	Second, we need to be able to contact you for many reasons, including at its most basic, in order to give you access to our mobile telephone internet based security guard app (the "Hero App").  Please provide us with your best telephone contact number, an email address that you have ready and frequent access to and your home address.

	Third, for the Hero App, we will need one or more images of you ("Your Image") to help our customers feel confident that the person who comes to their rescue is the person they are expecting!  To use Your Image, we need your consent to do so, including among other things your consent to use it on the Hero App, in Company advertising and promotional materials and other necessary and appropriate ways in the course of the Company's business.  Do you consent to this right of usage of Your Image by the Company?

	Fourth, when you are on duty as a Hero, the Company is going to have to keep track of your location at all time on the Hero App and our database, mainly in order to allow the customer to observe your progress to the customer location and to allow us to confirm the completion of your assignment and to locate you in case of any emergency or other incident.  Do you consent to our monitoring of your location during the time you are using the Hero App for these and other reasonable business uses?

	Fifth, there will be times, usually when you are on duty but occasionally not, when the Company will need to send you notifications, instructions, directions and other information.  Do you give us your consent to providing you with these notifications?

	Sixth, during the course of your work as a Hero, there may be times when you are going to be submitting incident reports, descriptions of events, providing narratives, taking photographs and transmitting them to us for review and assessment and other similar circumstances.  We will use all of this content and exchanged information (the "Communications") solely for reasonable business purposes, including things like filing police reports, complying with insurance requirements, defence of the Company and Heroes in legal actions and the like.  We will keep records of the Communications for such reasonable period of time as we think, or are advised by experts, is appropriate under the circumstances.  Do you consent to our gathering of Communications from you and our use of them as outlined above?

	Seventh, we will most likely be required to retain in our records, whether in written form, electronic, digital or otherwise, information relating to you as discussed in this Agreement, including for example your identification and contact information, Your Image, your locations, notifications from us to you and Communications (the "Retained Information").  We will take reasonable efforts to keep the Retained Information confidential and secure, as we do with all of our corporate records and customer data and information.  We will keep the Retained Information only for a reasonable amount of time, use it only for legitimate Company business purposes and share it only with your permission, as required by law or in connection with a legitimate use.  Do you consent to our storing and use of the Retained Information as summarised here?

	Eighth, we know that some of the information, agreements and consents contained in this Agreement may overlap with other policies, terms and conditions, rules, codes and instructions that form part of being a Hero and using the Hero App (the "Other Terms").  Nothing in this Agreement is intended to conflict with the Other Terms or to dilute them in any way.  But if there is a term addressed directly in this Agreement that does present a conflict with any of the Other Terms, the relevant term in this Agreement will prevail over the Other Term in the conflict.

	Ninth, this is a legal agreement, and is intended to and will bind both of us to its terms.  If a dispute arises between us over any issue under this Agreement, we both agree to the application of the laws of the State of New York and the jurisdiction of the appropriate courts in New York City.
